These Terms of Service (Terms) govern your access to and use of the floor04 client dashboard at app.floor04.com and any related services made available through that dashboard (the Service). By creating an account, logging in, or using the Service, you agree to these Terms.

1. Definitions

In these Terms:

  • "Customer" means the business or organisation that has purchased access to the Service.

  • "You" or "User" means any individual authorised by the Customer (and by floor04) to access the Service using their own Google or Microsoft account.

  • "Customer Data" means information submitted to, collected by, or generated through the Service relating to the Customer or its Users, including account details, usage metrics, and administrative settings.

  • "Third Party Services" means services provided by third parties that you may use in connection with the Service, including Google, Microsoft, Stripe, AWS, and Cloudflare.

2. About the Service

The Service provides a central dashboard for Customers to manage access to floor04 services, view usage analytics, access administrative features, and access Customer support options. The specific features available may change over time, and some features may be added, removed, or modified.

3. Eligibility and business use

  • The Service is intended for business and organisational use only.

  • You must be at least 18 years old to access or use the Service.

  • Access is permitted only for Users authorised by floor04 and by the Customer.

4. Accounts and access

Users must sign in using OAuth authentication via Google or Microsoft. Each User must use their own OAuth account and must not share login access with others.

  • Invitations: floor04 may invite a Customer to the Service. After the Customer has access, the Customer may invite additional Users, subject to floor04 authorisation controls.

  • Account security: you are responsible for maintaining the confidentiality of your account access and for all activities that occur under your account.

  • Accurate information: you must ensure information associated with your account is accurate and kept up to date.

5. Customer responsibilities

The Customer is responsible for:

  • ensuring its Users are authorised to access the Service and comply with these Terms;

  • maintaining appropriate internal policies and administrative controls, including role based access and invitations;

  • ensuring it has the rights and permissions necessary to provide Customer Data to floor04 and to link any Third Party Services;

  • complying with all applicable laws and regulations in Australia and the European Union that relate to its use of the Service.

6. Acceptable use

You must not:

  • use the Service for any unlawful purpose;

  • attempt to gain unauthorised access to the Service, accounts, systems, or networks;

  • interfere with or disrupt the integrity or performance of the Service;

  • reverse engineer, decompile, or otherwise attempt to derive source code or underlying ideas of the Service, except to the extent permitted by law;

  • introduce malicious code, viruses, or other harmful materials;

  • use automated means to access the Service in a manner that imposes an unreasonable load on our infrastructure.

7. Subscription, fees, and payment

Access to the Service may require a paid subscription. Subscriptions are purchased and managed through the web platform using Stripe.

  • Billing: fees, billing cycles, and included entitlements are as described at the time of purchase or in a separate written agreement with the Customer.

  • Taxes: fees may be subject to GST or other applicable taxes, which will be shown where required.

  • No card storage: floor04 does not store payment card details. Payment processing is handled by Stripe.

If you have a separate written agreement with floor04 (such as an order form or statement of work), that agreement may supplement these Terms. If there is a conflict, the separate written agreement will prevail to the extent of the conflict.

8. Exports and reporting

The Service may allow Users to export or download reports. You are responsible for how exported information is stored, shared, and protected after download.

9. Support communications

The Service allows Users to contact floor04 to request support. Support requests are not a live chat service. We will respond using reasonable efforts, subject to our support processes and any service level commitments agreed in writing.

10. Data protection and privacy

Our collection and use of personal information is described in our Privacy Policy. The Privacy Policy forms part of these Terms.

Data location: floor04 stores Service data in Australia. Where Customer Data is accessed from outside Australia (including from the European Union), it may involve cross border access to data stored in Australia.

Customer Data and analytics: the Service may display analytics and usage information. Where analytics relate to the Customer's own end users, the Customer is responsible for ensuring it has appropriate notices and lawful basis for collecting and sharing that data. floor04 designs analytics to avoid including directly identifiable information where practicable.

11. Cookies and similar technologies

The Service uses cookies and similar technologies that are necessary for authentication, security, and core functionality. If you do not accept these technologies, you may not be able to access or use the Service. More information is available in our Privacy Policy.

12. Third Party Services

The Service relies on or integrates with Third Party Services, including Google and Microsoft for OAuth login and Stripe for payments, and hosting and delivery providers such as AWS and Cloudflare.

  • Your use of Third Party Services is subject to their separate terms, policies, and settings.

  • floor04 is not responsible for Third Party Services and does not control their availability or performance.

  • You are responsible for maintaining your own accounts with Third Party Services and for any actions taken through those services.

13. Intellectual property

  • floor04 and its licensors own all intellectual property rights in the Service, including software, designs, and documentation.

  • We grant you a limited, non exclusive, non transferable, revocable licence to access and use the Service during the subscription term for the Customer's internal business purposes, in accordance with these Terms.

  • Except as expressly permitted by these Terms, you must not copy, modify, distribute, sell, or lease any part of the Service.

14. Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant floor04 a right to use that feedback without restriction or obligation to you, to the extent permitted by law.

15. Service changes and availability

  • We may change, suspend, or discontinue any part of the Service at any time.

  • We aim to keep the Service available, but we do not guarantee uninterrupted access.

  • Maintenance, outages, and events outside our reasonable control may affect availability.

16. Suspension and termination

We may suspend or terminate access to the Service immediately if we reasonably believe there is a breach of these Terms, a security risk, or unlawful activity.

The Customer may request account closure and deletion by contacting support through the dashboard support option or by emailing contact@floor04.com.

After termination or expiry, access to the Service will end. Some Customer Data may be retained as described in the Privacy Policy, unless the Customer requests data purging and we are able to comply with that request.

17. Disclaimers

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis. floor04 disclaims all warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non infringement.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory right, or remedy that cannot be excluded under applicable law. However, the Service is intended for business and organisational use.

18. Limitation of liability

To the maximum extent permitted by law, floor04 will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to the Service or these Terms.

To the maximum extent permitted by law, floor04's total aggregate liability for all claims arising out of or related to the Service or these Terms will not exceed the fees paid by the Customer to floor04 for the Service in the 12 months immediately preceding the event giving rise to the claim.

19. Indemnity

The Customer will indemnify and hold harmless floor04 from and against claims, damages, liabilities, and expenses arising from:

  • the Customer Data, including any allegation that Customer Data infringes rights of a third party;

  • use of the Service by the Customer or its Users in breach of these Terms or applicable law;

  • the Customer's relationship with its own end users and any data collection or notices provided to them.

20. Governing law and jurisdiction

These Terms are governed by the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of Queensland, Australia.

21. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify the Customer, such as by posting an update in the Service. Your continued use of the Service after the updated Terms take effect means you accept the updated Terms.
